PETRONICS RETURNS AND LIMITED WARRANTY POLICY

RETURNS

The original purchaser (“you” or “your”) may return any Mousr robot or accessory tail (each, a “Product”) sold by Petronics, Inc. (“Petronics”) for a full refund up to 30 days from the date of purchase, as long as the Product is returned in “like new” condition, in the original packaging (whenever possible), and with all accessories (e.g., batteries).

To return a Product, please follow these steps:

  1. Contact Petronics by email at [email protected] to receive shipping instructions.
  2. Pack the Product securely in the original packaging (whenever possible).
  3. Enclose a scan of the original sales receipt with the Product. If you cannot locate the original sales receipt, include the return form that Petronics provides.
  4. Obtain a return tracking number to ensure the Product reaches Petronics. Petronics is not responsible for issuing a refund unless Petronics receives the returned Product.

You will retain title to the returned Product until Petronics receives and accepts it at Petronics’s return center. Petronics is not responsible for loss or damage in transit.

All return shipping charges must be prepaid. Petronics will not accept C.O.D. deliveries.

You should return the Product using a nationally-recognized courier service such as UPS, FedEx, or DHL.

Petronics will evaluate the condition of each returned Product. If Petronics confirmations that the returned Product is in “like new” condition, it will issue a refund of the original purchase price and applicable taxes (but not shipping or gift-wrap costs) to you in the same form as the original payment was made within 30 days of Petronics confirmation of the condition of the returned Product.

If Petronics reasonably determines that a returned Mousr robot is not in “like-new” condition, Petronics will process the returned Mousr robot as a warranty claim. Petronics will contact you with options for the disposition of other returned Products that are not in “like-new” condition, which include Petronics returning the Products to you at your expense or retaining and destroying the Products.

OVERVIEW OF LIMITED WARRANTY

Subject to the exclusions set forth in the Section titled “What Is Not Covered?” below (the “Exclusions”), Petronics warrants that each Mousr robot (but not another Product) is free from defects in material and workmanship for one year from the date that you receive it (the “Warranty Period”). If you return a Mousr robot during the Warranty Period and Petronics confirms that the Mousr robot fails to meet the warranty for reasons other than one of the Exclusions, Petronics will, within a commercially reasonable time, provide one of the remedies listed in the Section titled “Warranty Remedies” below and refund any reasonable, actual, documented shipping charges that you incur returning the Mousr robot to Petronics.

This limited warranty is only available to, and enforceable by, original purchasers of Mousr robot located in the United States. However, you may contact Petronics to discuss your options if you received the Mousr robot as a gift or are located in a country other than the United States.

MAKING A CLAIM UNDER THE LIMITED WARRANTY

To submit a warranty claim for a Mousr robot, please follow these steps:

  1. Contact Petronics by email at [email protected] and include the serial number of your Mousr robot and the original sales receipt (or other reasonable documentation showing the date of purchase).
  2. If Petronics verifies that the Warranty Period for the Mousr robot has not expired, Petronics will provide shipping instructions.
  1. Pack the Mousr robot securely in the original packaging (whenever possible).
  2. Enclose a scan of the original sales receipt with the Mousr robot. If you cannot locate the original sales receipt, include the return form that Petronics provides.
  3. Obtain a return tracking number to ensure the Mousr robot reaches Petronics. Petronics is not responsible for replacing a Mousr robot, making warranty repairs, or issuing a refund unless Petronics receives the Mousr robot.

You will retain title to the Mousr robot until Petronics receives and accepts it at Petronics’s return center. Petronics is not responsible for loss or damage in transit.

All shipping charges must be prepaid. Petronics will not accept C.O.D. deliveries.

You should ship the Mousr robot using a nationally-recognized courier service such as UPS, FedEx, or DHL.

You must notify Petronics of any damage to or defect in a Mousr unit before the expiration of the Warranty Period. You must return the defective Mousr robot to Petronics within 30 days from the date Petronics confirms to you that the Warranty Period for the Mousr robot has not expired.

In order to receive reimbursement of your shipping charges, you must be able to present Petronics with a copy of the postage charged to you by the nationally-recognized courier service you use to return the defective Mousr robot.

WARRANTY REMEDIES

If Petronics receives a warranty claim within the Warranty Period and your Mousr robot within 30 days from the date Petronics confirms to you that the Warranty Period has not expired, Petronics will, within a commercially reasonable time, inspect the Mousr robot to verify, to Petronics’s reasonable satisfaction, that the damage or defect was not caused by one of the Exclusions. Then, Petronics will, at Petronics’s cost and option:

  1. repair the Mousr robot and return it to you;
  1. exchange the Mousr robot with a Product that is new or which has been manufactured from new or serviceable used parts and is at least functionally equivalent to the Mousr robot that you returned;
  2. exchange the Mousr robot with a Product that is a new and upgraded model with at least equivalent or upgraded functionality; or
  3. refund the purchase price of the Mousr robot.

To the extent permitted by applicable laws, the Warranty Period will not be extended or renewed or otherwise affected due to subsequent exchange, resale, repair or replacement of the Mousr robot. However, parts repaired or replaced during the Warranty Period will be warranted for the remainder of the original Warranty Period or for 30 days from the date you receive the replacement Mousr robot, whichever is longer.

Petronics will return the repaired or replacement Mousr robot to you as soon as commercially practicable.

All defective parts or Mousr robots that Petronics replaces become Petronics’s property upon Petronics’s receipt. If Petronics reasonably determines that a defective Product is not covered by this limited warranty, Petronics may offer to repair or replace the defective Product for a fee, return it to you at your cost, or retain and destroy it.

WHAT IS NOT COVERED?

Unless agreed in writing, this limited warranty will not apply if Petronics reasonably determines that the defect or damage was caused by or relates to any of the following Exclusions:

  1. normal wear and tear;
  2. rough or inappropriate handling or use (including, without limitation, damage caused by children or pets);
  3. willful or deliberate acts or negligence;
  4. accidents, neglect, fire, water, lightning, or other acts of nature;
  5. use outdoors or in a commercial environment;
  6. use outside of the United States;
  7. use of batteries in equipment other than the Mousr robot they were supplied with or in a manner not in compliance with battery warnings and instructions provided by Petronics;
  8. use of the Mousr robot not in compliance with the operating instructions (including, without limitation, use outside the presence of adults or with pets other than cats);
  9. use of accessories, spare parts or other replacement items (including consumables) with the Mousr robot that are not provided or recommended by Petronics;
  10. any alteration or modification to the Mousr robot carried out by you or a third party who is not authorized by Petronics;
  11. any failure to adequately package the Mousr robot for transportation when it is returned to Petronics;
  12. causes beyond Petronics’s reasonable control including, but not limited to, breakdowns, fluctuations, or interruptions in electric power;
  13. any Mousr robot purchased from an unauthorized reseller;
  14. if the Product’s serial number has been removed, erased, defaced, altered or is illegible in any way; or
  15. you are in breach of the terms of this limited warranty or any other agreements with Petronics.

LIMITATION OF PETRONIC’S LIABILITY

TO THE EXTENT PERMITTED BY LAW, THIS LIMITED WARRANTY IS YOUR SOLE AND EXCLUSIVE REMEDY AGAINST PETRONICS INC., ANY OF PETRONICS’S AFFILIATES, ANY OF PETRONICS’S AUTHORIZED RESELLERS, AND ANY OWNER OR OPERATOR OF ANY OF PETRONICS’S SALES CHANNELS (COLLECTIVELY, THE “COVERED PARTIES”) AND THE COVERED PARTIES’ SOLE AND EXCLUSIVE LIABILITY WITH RESPECT TO DAMAGE OR DEFECTS IN YOUR PRODUCT OR ANY RELATED LOSS OR DAMAGE CAUSED BY SUCH DAMAGE OR DEFECTS.

TO THE EXTENT PERMITTED BY LAW, THIS LIMITED WARRANTY REPLACES ALL OTHER WARRANTIES OF PETRONICS INC. AND ITS AFFILIATES, WHETHER ORAL, WRITTEN, (NON-MANDATORY) STATUTORY, CONTRACTUAL, IN TORT OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES AS TO SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. HOWEVER, SOME JURISDICTIONS DO NOT ALLOW A DISCLAIMER OF WARRANTIES OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY BY JURISDICTION.

TO THE EXTENT PERMITTED BY LAW, THE COVERED PARTIES DO NOT ASSUME ANY LIABILITY FOR ANY (A) LOSS OF, DAMAGE TO, OR CORRUPTION OF DATA, (B) LOSS OF PROPERTY OR COMPANIONSHIP, (C) LOSS OF PROFITS, (D) LOSS OF USE OF PRODUCTS OR FUNCTIONALITY, (E) LOSS OF BUSINESS, CONTRACTS, REVENUES, OR ANTICIPATED SAVINGS, (F) INCREASED COSTS, OR EXPENSES, OR (G) ANY INDIRECT LOSS OR DAMAGE, CONSEQUENTIAL LOSS OR DAMAGE OR SPECIAL LOSS OR DAMAGE. HOWEVER, SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

TO THE EXTENT PERMITTED BY LAW, THE COVERED PARTIES’ LIABILITY WILL BE LIMITED TO THE PURCHASE PRICE OF THE PRODUCT. THE ABOVE LIMITATIONS WILL NOT APPLY TO THE EXTENT CAUSED BY THE GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT OF THE COVERED PARTIES OR TO THE EXTENT CAUSED BY DEATH OR PERSONAL INJURY RESULTING FROM THE COVERED PARTIES’ PROVEN NEGLIGENCE.

NO OTHER WARRANTIES

None of Petronics’s resellers, sales channel operators, agents, or employees is authorized to make any modification, extension, or addition to this limited warranty.  If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.

LiPo BATTERY WARNING

  • Lithium-ion polymer (LiPo) batteries include hazardous materials that can cause serious injuries to persons, pets, or property if used or disposed improperly. It is important for the user of any Mousr robot (“User”) to read and follow the instructions below.  By using the Mousr robot, User accepts sole liability for the proper use and disposal of the Mousr robot’s LiPo battery.
  • User should immediately discontinue use of the battery if, while using, charging, or storing the battery, it emits an unusual smell, feels hot, changes color or shape, or appears otherwise deformed in any other way.
  • In the event of battery leakage or puncture, User should avoid personal or pet contact with the battery or battery liquid. In case of contact with the skin, thoroughly wash area with soap and water and consult a doctor or veterinarian. In case of contact with the eyes, rinse thoroughly with cold water and consult a doctor or veterinarian. 

CHARGING

  • Never overcharge a LiPo battery. Never “trickle” charge a LiPo battery.
  • Do not use a charger with damage to the cord, plug, enclosure, or other parts. Use only the supplied USB cable plugged into the USB port on your computer or a UL-certified USB wall charger. Misuse can cause damage to the Mousr robot or cause electrical shock.
  • Do not use the Mousr robot’s charger to charge any battery other than the rechargeable battery provided with the Mousr robot.
  • Do not charge the battery near flammable materials.
  • Do not leave the Mousr robot unattended during charging.
  • Do not charge the Mousr robot immediately after use while the battery is still hot. Allow battery sufficient time to cool to an ambient temperature before charging.
  • Batteries are only to be charged under adult supervision.
  • Never store, use, or charge a battery pack inside your in extreme temperatures. Ensure battery exposure is limited to temperatures between 0ºC - 40ºC (32ºF - 104ºF).
  • Do not cover the Mousr robot or its charger while the battery is charging.

 USE, MAINTENANCE, AND STORAGE

  • Keep pets away from an exposed battery.
  • Do not store the Mousr robot or battery in your pet’s crate or bedding.
  • Do not use the Mousr robot if its battery cover has been broken or the battery’s casing has been damaged in any way.
  • Do not store the battery inside vehicles.
  • Do not expose the battery to excessive physical shock or impact.
  • Do not expose the Mousr robot or its battery to a heat source or dispose of it in a fire.
  • Do not expose the Mousr robot or its battery to water or salt water, or allow the battery to get wet.
  • Do not put the battery in a microwave oven, inductive cookware, or in a pressurized container.
  • Do not attempt to modify, dismantle, pierce, distort, or cut the battery or charger and do not attempt to repair a damaged battery or charger.
  • Do not place any heavy objects on the Mousr robot or its battery.
  • Disconnect the charger when you are not charging the battery.

PRODUCT DISPOSAL

At the end of the Mousr robot’s life, do not dispose of the Mousr robot’s LiPo battery with other household waste.  Dispose or recycle the battery separately in accordance with local laws and regulations. Contact User’s local municipality for disposal or recycling information.

BATTERY DISPOSAL

Damaged or unusable batteries must be properly disposed of. When disposing of the battery, follow appropriate local guidelines and regulations. For further information, contact User’s local solid waste authority.
